			<content:encoded><![CDATA[<p></p><p>Racketeering is the act of operating an illegal business or scheme in order to make a profit and is often perpetuated by an organized group. The act that constitutes racketeering covers a broad range of crimes such as extortion, bribery, embezzlement, and illegal gambling etc.</p>
<p>The Racketeer Influenced Corrupt Organization Act (RICO) is the federal law that is enforced against racketeering activity and targets “mob” activity. Unlike many federal statutes that target white-collar crime, violation of RICO carries hefty pre- and post- penalties.</p>
<p>Defendants convicted of RICO violations are faced with a maximum fine of $25,000 or double the proceeds from the prohibited activity and up to twenty years in jail.</p>
<p><strong>But the power of RICO violations does not stop there…</strong></p>
<p>Unlike most federal statutes, RICO permits a District Court, (Eastern District for Long Island based cases) upon application of the prosecutor, to restrain, enjoin or prohibit the transfer or diffusion of potentially forfeitable assets <strong>before</strong> the defendant is found guilty.</p>
<p>What does this mean? Your bank accounts, real property, and any forfeitable assets will be frozen once the prosecutor submits the request to freeze all questionable assets.</p>
